ICC: Special session of the Assembly on disciplinary proceedings involving an elected official – Closure of the session

Excellency' distinguished delegates, I call to order our resume session second plenary meeting, which is being held in public.
The Assembly of States Parties is mindful of the considerable interest of the disciplinary proceedings involving an elected official upon which the Assembly has taken a decision today.
At the outset, I wish to thank all delegates for their constructive approach and for their close consideration of the 8th of June decision of the Bureau, the OIS investigative report, and underlying evidence, the panel report, the submissions of the prosecutor to the panel and to the bureau and the submissions of VO one to the Bureau, which were the foundational material upon which the Assembly decision has been taken.
In that regard, I emphasize that the Bureau and the Assembly of States parties have decided this matter within the context in which it is.
It is an internal workplace complaint of prohibited conduct by an elected official against a subordinate staff member.
The Bureau of the Assembly of States Parties have taken their decisions in full adherence to the legal framework of the International Criminal Court and with full respect for the due process rights of the elected official and the rights of the affected persons.
The Assembly has decided by maturity of 82 states parties that the elected official Prosecutor Karim Kan committed serious misconduct and a serious breach of duty under Article 461 of the Rome statute and to remove the elected official Prosecutor Karim Kan from office under Article 46 paragraph two B of the Rome statute.
Prior to closing this plenary session, I wish to underscore that within the legal framework of the International Criminal Justice Criminal Court, complaints of misconduct investigations and disciplinary proceedings are confidential matters.
I continue to call for respect for the dignity and privacy of all those involved.
I In closing, I express my deep appreciation to the Assembly of States parties for their diligent consideration of this difficult matter and for the spirit of unity shown in upholding the integrity of the court.
I acknowledge the dedication of the court staff who have continued to work tirelessly in the implementation of the court's critical mandate during this prolonged period of uncertainty.
While the court may have more challenges ahead, the Assembly's navigation of this difficult matter, coupled with the dedication of the court staff and elected officials, has demonstrated the resolve to continue to support the court through difficult times and to ensure that it can discharge its critical mandate in the interests of the international community as a whole and victims of atrocity crimes the world over.
With these words, I would like to declare this special session I do recognize the delegation of Japan for the floor.

Madam President, distinguished delegates, I'd like to commend the leadership of ASP President Pay Calpraa who led this extraordinarily complex discretionary process.
We welcome the fact that due process was followed under our guidance.
Japan legals that the assembly has functioned properly in accordance with the procedures under the Rome statute.
Despite his position requiring him to be a person of high moral character under the long statute, the series of conducts undertaken by the prosecutor must be seen to have undermined the credibility of the ICC.
Taking the view that this extremely regrettable situation should be rectified properly at the earliest possible opportunity, Japan has actively contributed to discussions as a member of the Bureau of the ISP.
Japan welcomes the Assembly's decision to remove the prosecutor.
The ICC is the world's only permanent international criminal tribunal.
In order for the ICC to gain the trust of the international committee, it's important for ICC prosecutor to carry out the duty properly and for the ICC and state parties to address the challenges facing the ICC in a follow manner so that the code is administered appropriately.
Japan for its part will continue to fulfill its role as a state party participating in relevant discussions.
